Overview

Tempe is a compact, densely developed city bordering Phoenix, and its fire feature rules reflect that density. Tempe falls within MCAQD's curtailment jurisdiction and has its own building department. Because Tempe lots tend to be smaller than suburban Phoenix or Scottsdale, the 25-foot recreational fire setback is often difficult to meet — many Tempe homeowners opt for enclosed portable units (qualifying for the 15-foot portable outdoor fireplace setback) or gas fire features.

Building Permits in Tempe

Tempe Community Development — Building Division issues permits. Apply online at tempe.gov/building or call 480-350-8341. Tempe's permit process for simple residential accessories is typically efficient, with over-the-counter service available for straightforward projects.

Small Lot Considerations

Tempe's residential lots average 6,000–8,000 sq ft in most neighborhoods. On a 6,000 sq ft lot with a 1,400 sq ft house, meeting the 25-foot setback from all combustible material on all sides is often geometrically impossible for an open fire pit. A portable enclosed fire bowl under IFC 307.4.3 with a 15-foot setback, or a gas fire feature placed within standard zoning setbacks, are the common solutions. Verify which IFC edition Tempe has adopted before relying on the 15-foot portable provision.

MCAQD Rules

Same as Phoenix and Scottsdale — wood-burning curtailment days run October through April. Gas features are exempt. Check maricopa.gov/1854.
